Worked examples

ATO example: Division 293 income of $240,000 and concessional contributions of $15,000 add up to $255,000. That's $5,000 over the threshold, which is less than the $15,000 of contributions. Division 293 tax = 15% × $5,000 = $750.

Income already over $250,000: income $300,000 and contributions $30,000. The excess over $250,000 ($80,000) is more than the contributions, so all $30,000 is taxed: 15% × $30,000 = $4,500.

Salary sacrifice that tips you over: income $230,000 and contributions $32,500 total $262,500. Division 293 tax = 15% × $12,500 = $1,875.

How it works

  1. Division 293 income = taxable income + reportable fringe benefits + net financial investment loss + net rental property loss + amounts on which family trust distribution tax was paid − any super lump sum taxed element taxed at a zero rate − any assessable first home super saver released amount. (This is income for Medicare levy surcharge purposes without reportable super contributions.)
  2. Low tax contributions = concessional contributions minus any excess concessional contributions.
  3. If the two add up to more than $250,000, the tax is 15% of the lower of the contributions and the amount over $250,000.

The ATO sends a separate Division 293 assessment after you lodge. You can pay it yourself or release the amount from your super fund. Defined benefit and some government funds can defer it to a debt account instead.

FAQ

What is the Division 293 threshold?

$250,000. Division 293 tax applies when your Division 293 income plus your low tax (concessional) contributions is more than $250,000. The threshold is the same for 2025-26 and 2026-27.

How is Division 293 tax calculated?

It’s 15% of the lower of your low tax contributions and the amount by which your Division 293 income plus those contributions is over $250,000. For example, $240,000 of income plus $15,000 of contributions gives 15% × $5,000 = $750.

Is salary sacrifice still worth it if I pay Division 293?

Usually yes. With Division 293, contributions are taxed at about 30% in total, compared with a marginal rate of up to 47% including the Medicare levy. The gap is smaller, so the saving is smaller.

Do excess concessional contributions count for Division 293?

No. Excess concessional contributions are taxed at your marginal rate instead, so they’re taken out of your low tax contributions to avoid double taxation.

How do I pay Division 293 tax?

The ATO issues a separate assessment after you lodge your return. You can pay it from your own money, or use a release authority to have your super fund pay it. Members of some defined benefit funds have it deferred to a debt account.

Does a rental property loss reduce Division 293 income?

No, the opposite. Net rental property losses and net financial investment losses are added back to your taxable income to work out Division 293 income.
